These Terms and Conditions ("Terms") govern your use of the website Rugs.net and every purchase you make from it. Rugs.net is operated from 371 South Main St., Freeport, NY 11520. By using this website or placing an order, you accept these Terms in full. If you do not agree with them, please do not use the website.

1. Use of the Website

You may use this website only for lawful purposes and only to browse and purchase rugs for your own use. You must be at least 18 years old, or the age of majority in your state, to place an order. You agree not to interfere with the operation of the website, not to access it by automated means such as scrapers or bots, and not to use it in any way that could damage or overburden it.

2. Products and Descriptions

Every rug we sell is individually handmade. Small variations in size, color, design, and knotting are inherent to hand-knotted rugs and are part of their character, not defects. Sizes are measured per rug and stated in the listing. Colors on your screen depend on your display settings and may differ somewhat from the rug itself. We work hard to describe and photograph every rug accurately, but such natural variations are not grounds for a claim beyond your return rights described below.

3. Pricing, Orders, and Payment

All prices are stated in US dollars. Despite our best efforts, a small number of listings may contain pricing or typographical errors. We reserve the right to cancel any order arising from such an error, in which case you receive a full refund of any amount paid. Your order is an offer to purchase. A contract is formed only when we confirm shipment of your rug. We may decline or cancel an order at our discretion before shipment, for example in cases of suspected fraud, and will refund any payment in full if we do.

4. Shipping and Delivery

We ship free to all 50 states, Puerto Rico, the US Virgin Islands, and Canada, at any size and weight. Orders placed by 2 PM EST on a weekday ship the same day. In our Northeast 13-state zone, our own drivers deliver in a guaranteed 24 to 48 hours and hand the rug over at your door. Import taxes and duties may apply to orders shipped outside the US and are the responsibility of the recipient. Title and risk of loss pass to you upon delivery. 5. Returns

You may return any rug within 31 days of delivery. Returns ship free from the mainland US. Return shipping from Puerto Rico, the US Virgin Islands, Hawaii, Alaska, and Canada is at your cost. Returned rugs must be in the condition in which you received them. The complete return procedure is described on our shipping and returns page.

6. Intellectual Property

All content on this website is the exclusive property of Rugs.net. This includes, without limitation, all photographs, all videos, all product descriptions, articles, guides, page designs, logos, and the Rugs.net name and brand line. No photograph, video, or other content from this website may be copied, downloaded, reproduced, published, distributed, or used in any form or medium without our prior written permission. This applies to commercial and non-commercial use alike, including use on other websites, marketplaces, social media, and in print. If you wish to use any of our images or videos, contact us first and wait for written permission. Unauthorized use will be pursued to the full extent of the law.

7. Disclaimer of Warranties

Except for the express statements made in the product listing itself, every rug is sold as is. To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose. The website itself is provided as is and as available, and we do not warrant that it will be uninterrupted or error-free. Nothing in this section limits your return rights under section 5 or any rights you hold under applicable law that cannot be disclaimed.

8. Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms, the website, or any purchase is limited to the amount you paid for the rug giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, even if we have been advised of the possibility of such damages. Some states do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Rugs.net, its owners, and its employees from any claims, damages, and expenses, including reasonable attorney fees, arising out of your violation of these Terms or your misuse of the website or its content, including any unauthorized use of our photographs or videos.

10. Governing Law, Arbitration, and Venue

These Terms and any dispute arising out of or relating to them, the website, or any purchase are governed by the laws of the State of New York, without regard to its conflict of law principles.

Any dispute that cannot be resolved informally shall be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration shall be Nassau County, New York. Either party may instead bring an individual claim in small claims court in Nassau County, New York, if the claim qualifies. You and Rugs.net each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or any other representative proceeding. All claims must be brought in the party's individual capacity only.

For any dispute that is found not subject to arbitration, you and Rugs.net agree that the state and federal courts located in Nassau County, New York shall have exclusive jurisdiction, and you consent to personal jurisdiction and venue in those courts and waive any objection based on an inconvenient forum.

11. General Provisions

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, and carrier disruptions. If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force. These Terms, together with our shipping and returns page and our privacy policy, are the entire agreement between you and Rugs.net regarding the website and your purchases. We may update these Terms at any time by posting the revised version on this page with a new date. Your continued use of the website after an update constitutes acceptance of the revised Terms.
